Bolsonaro’s AI double tests the limits of Brazil’s election law

Jair Bolsonaro is barred from standing in Brazil’s presidential election and prohibited from communicating publicly while under house arrest. Yet an artificial intelligence-generated version of the former president has appeared at the launch of his son’s campaign, creating an unprecedented legal test over whether a virtual politician can campaign when the real person cannot.
A forbidden candidate returns virtually
The synthetic Bolsonaro appeared on a large screen during the Liberal Party’s national convention in São Paulo, where Senator Flávio Bolsonaro formally launched his campaign for October’s presidential election.

The video openly stated that it had been created with artificial intelligence. The avatar then presented Flávio as the political successor chosen to continue his father’s conservative movement.

Jair Bolsonaro remains one of Brazil’s most influential political figures despite being declared ineligible to hold public office until 2030. He is also under house arrest following his conviction for attempting to overturn the result of the 2022 election, which he lost to President Luiz Inácio Lula da Silva.

Judicial restrictions prevent the former president from communicating directly with the public. The AI appearance therefore raised an immediate question: can a synthetic version deliver a political message that the real Bolsonaro is legally forbidden from making?

The video allowed Flávio’s campaign to benefit from his father’s image, voice and emotional connection with conservative voters without requiring Jair Bolsonaro to appear or record a new statement.

Political opponents challenge the video
A coalition of left-wing and centre-left parties filed a complaint with Brazil’s Superior Electoral Court, arguing that the video violated rules governing synthetic political content.

The parties said electoral regulations prohibit artificially generated material that reproduces a real person when it is capable of influencing voters. They also warned that AI could become a way of circumventing restrictions imposed by courts.

Flávio Bolsonaro’s legal team rejected that interpretation. It argued that the video was clearly labelled as artificial intelligence, contained no attempt to deceive the audience and did not combine genuine footage with manipulated images.

The campaign maintained that the presentation should therefore not be classified as a prohibited deepfake.

Justice Kassio Nunes Marques, president of the electoral court, said AI could be used for campaigning but must not be employed to harm another person. He declined to comment directly on the Bolsonaro case before it is formally considered.

Brazil’s rules face their first major test
Brazil requires political material created with AI to be clearly identified. Electoral rules also prohibit fabricated or manipulated content that spreads false information, misleads voters or damages the integrity of an election.

AI-generated campaign material cannot be distributed during the 72 hours before voting or the 24 hours after polls close. Chatbots and virtual assistants are also prohibited from recommending candidates or telling users how to vote.

The Bolsonaro video, however, occupies a less clearly defined area. It was labelled as synthetic and did not falsely claim to be an authentic recording. At the same time, it recreated a real political leader for the explicit purpose of supporting a candidate.

Legal experts say Bolsonaro himself may avoid punishment by arguing that he neither recorded nor authorised the message. Responsibility could instead fall on the campaign, party officials or those who created and distributed the video.

A digital surrogate on the campaign trail
Flávio Bolsonaro is attempting to challenge Lula, who is seeking a fourth non-consecutive presidential term. A recent Datafolha poll placed Lula ahead by 48 per cent to 43 per cent in a possible second-round contest.

The former president’s endorsement remains essential to Flávio’s effort to unite Brazil’s right, but his physical and legal absence creates a significant obstacle.

Whether the avatar becomes a regular feature of the campaign will depend largely on the electoral court’s ruling. If permitted, it could provide Bolsonaro with a continuing virtual presence. If prohibited, the case may establish one of the world’s first clear boundaries against using AI as a substitute for a politically restricted leader.
